1. Genel Bilgiler ve Kabul

Bu Kullanım Şartları ve Gizlilik Politikası ("Şartlar"), plssem.com web sitesi ("Site") ile bu site üzerinden sunulan Data Analysis Robot yazılım hizmetinin ("Hizmet") kullanım koşullarını belirlemektedir.

Siteyi ziyaret etmek, herhangi bir özelliğini kullanmak veya veri yüklemek suretiyle bu Şartları okuduğunuzu, anladığınızı ve kabul ettiğinizi beyan etmiş olursunuz. Bu Şartları kabul etmiyorsanız Hizmet'i kullanmayınız.

2. Hizmetin Kapsamı ve Sınırlamaları

Hizmet, akademik araştırma amaçlı PLS-SEM (Kısmi En Küçük Kareler Yapısal Eşitlik Modellemesi), CFA (Doğrulayıcı Faktör Analizi), Nitel Veri Analizi, Bibliyometrik Veri Analizi Eye-Tracking Analizi işlemlerini gerçekleştiren çevrimiçi bir analiz aracıdır.

  • Yalnızca akademik ve araştırma amaçlı kullanım içindir.
  • Desteklenen dosya formatları: Excel (.xlsx, .xls), CSV
  • Maksimum dosya boyutu: 50 MB
  • Hizmet, herhangi bir bildirim yapılmaksızın değiştirilebilir, askıya alınabilir veya sonlandırılabilir.

3. Üçüncü Taraf Yazılımlar ve Sorumluluk Reddi

⚠️ Bu bölüm, Hizmet'in teknik altyapısına ilişkin önemli sorumluluk sınırlamalarını içermektedir. Lütfen dikkatlice okuyunuz.

plssem.com'un analiz motoru, tamamen açık kaynak Python kütüphaneleri üzerine inşa edilmiştir. Bu kütüphaneler; istatistiksel hesaplama, modelleme, regresyon, örnekleme ve veri işleme süreçlerini yürütmektedir. Kullanılan başlıca bağımsız yazılım bileşenleri şunlardır:

  • semopy — Yapısal eşitlik modellemesi (SEM) kütüphanesi
  • pandas — Veri çerçevesi işleme ve manipülasyon
  • numpy — Sayısal hesaplama altyapısı
  • scipy — İstatistiksel fonksiyonlar
  • scikit-learn — Makine öğrenmesi ve istatistik araçları
  • statsmodels — Ekonometrik ve istatistiksel modeller
  • FastAPI — Web uygulama çerçevesi

Bu kütüphaneler, plssem.com tarafından geliştirilmemiş olup her birinin kendi lisans şartları, hata payları ve sürüm kısıtlamaları mevcuttur. plssem.com, söz konusu üçüncü taraf yazılımların:

  • Hatalı, eksik veya yanıltıcı sonuç üretmesinden,
  • Belirli veri setleriyle uyumsuz çalışmasından,
  • Sürüm güncellemeleri nedeniyle davranış değişikliği göstermesinden,
  • Hesaplama süreçlerinde meydana gelebilecek matematiksel sapmalardan,
  • Bootstrap, regresyon veya faktör analizinde oluşabilecek yakınsama hatalarından

hiçbir şekilde sorumlu tutulamaz. Kullanıcı, bu yazılımların doğasından kaynaklanan sınırlılıkları baştan kabul etmiş sayılır.

4. Analiz Sonuçlarının Doğruluğu ve Akademik Sorumluluk

🔴 Önemli Uyarı: plssem.com tarafından üretilen analiz sonuçları, akademik çalışmalarda kullanılmadan önce kullanıcı tarafından bağımsız olarak doğrulanmalıdır.

Hizmet "olduğu gibi" (as-is) sunulmaktadır. Analiz sonuçlarının doğruluğu, eksiksizliği veya belirli bir amaca uygunluğu konusunda açık ya da zımni hiçbir garanti verilmemektedir.

Kullanıcı; akademik yayın, tez, proje veya herhangi bir resmi belgede bu sonuçları kullanmasından doğan tüm bilimsel, etik ve hukuki sorumluluğu münhasıran üstlenir. plssem.com ve geliştiricisi, yanlış yorumlanan veya doğrulanmayan sonuçların kullanımından kaynaklanan hiçbir zarardan sorumlu değildir.

5. Premium Erişim ve Key Sistemi

Hizmetin bazı özellikleri (Bootstrap 5000, CFA Analizi, Word Raporu indirme), Nitel Veri Analizi, Bibliyometrik Veri Analizi Eye-Tracking modülü yalnızca geçerli bir erişim key'i ile kullanılabilir. Key sistemi hakkında şunlar geçerlidir:

  • Her key, yalnızca bir cihaza bağlanır. İlk kullanımda cihaz kaydı gerçekleşir.
  • Key başkasına devredilmesi veya paylaşılması kesinlikle yasaktır.
  • Süreli key'ler belirtilen tarihte otomatik olarak geçersiz hale gelir.
  • Key'ler herhangi bir zamanda, herhangi bir gerekçe gösterilmeksizin iptal edilebilir.
  • Key satın alım veya devir işlemleri herhangi bir iade veya tazminat hakkı doğurmaz.
  • plssem.com, key sistemini değiştirme, kaldırma veya yeniden yapılandırma hakkını saklı tutar.

6. Veri Gizliliği ve Kişisel Veri

✅ plssem.com herhangi bir kişisel veri toplamamaktadır. Sisteme kayıt, isim, soyisim, e-posta veya telefon numarası gibi bilgiler talep edilmemekte ve saklanmamaktadır.

Kullanıcı tarafından yüklenen veri dosyaları (Excel, CSV vb.):

  • Yalnızca analiz süresince sunucu belleğinde geçici olarak tutulur.
  • Analiz tamamlandığında veya oturum sona erdiğinde otomatik olarak silinir.
  • Sunucuya kalıcı olarak kaydedilmez, üçüncü taraflarla paylaşılmaz.
  • Yedeklenmez ve arşivlenmez.

Bu Hizmet, 6698 sayılı Kişisel Verilerin Korunması Kanunu (KVKK) kapsamında kişisel veri işlememektedir. Avrupa Birliği kullanıcıları için Genel Veri Koruma Tüzüğü (GDPR) kapsamında da kişisel veri işlenmemektedir.

7. Cihaz Tanımlama, IP Kaydı ve Teknik Veriler

Hizmet, aşağıdaki teknik verileri güvenlik ve erişim yönetimi amacıyla işleyebilir:

  • IP adresi: Her API isteğinde sunucu tarafından alınır. Key doğrulama işleminde cihaz kaydı için kullanılır ve key kaydına işlenir.
  • Tarayıcı parmak izi (Browser Fingerprint): Ekran çözünürlüğü, tarayıcı dili, saat dilimi, işletim sistemi platformu ve benzer tarayıcı özelliklerinin karma (hash) değeri hesaplanarak key'e bağlanır. Bu veri, kişiyi tanımlamaya yeterli değildir; yalnızca cihaz eşleştirmesi amacıyla kullanılır.
  • Kullanım istatistikleri: Key başına kullanım sayısı ve son kullanım tarihi kaydedilir.
  • Sunucu logları: Teknik hatalar ve güvenlik olayları için standart sunucu günlükleri tutulabilir.

Bu veriler üçüncü taraflarla paylaşılmaz, reklam amaçlı kullanılmaz ve kullanıcı profillemesi yapılmaz.

8. Fikri Mülkiyet Hakları

plssem.com üzerindeki tüm özgün yazılım kodu, arayüz tasarımı, içerik ve metodoloji Dr. Yavuz Toraman'a aittir ve telif hukuku kapsamında korunmaktadır.

  • Yazılımın kaynak kodunun kopyalanması, tersine mühendislik uygulanması veya türev yazılım geliştirilmesi yasaktır.
  • Site içeriğinin izinsiz çoğaltılması veya dağıtılması yasaktır.
  • Kullanıcı tarafından yüklenen veriler kullanıcıya aittir; plssem.com bu veriler üzerinde hiçbir hak iddia etmez.
  • Hizmet kapsamında üretilen analiz çıktıları akademik amaçla kullanılabilir; ancak kaynak gösterilmesi tavsiye edilir.

Üçüncü taraf açık kaynak kütüphaneleri kendi lisans şartları (MIT, BSD, Apache vb.) çerçevesinde kullanılmaktadır.

9. Kullanıcı Yükümlülükleri ve Yasaklar

Kullanıcı, aşağıdaki eylemleri gerçekleştirmemeyi kabul eder:

  • Hizmet'e bot, otomatik script veya scraper ile erişmek,
  • Key'i başkasıyla paylaşmak veya birden fazla cihazda kullanmaya çalışmak,
  • Hizmet'i kötü amaçlı, yanıltıcı veya yasadışı amaçlarla kullanmak,
  • Hizmet'in güvenlik mekanizmalarını aşmaya çalışmak,
  • Yasa dışı, gizli veya üçüncü taraf haklarını ihlal eden veri yüklemek,
  • Hizmet sunucularına aşırı yük bindirmek veya DDoS saldırısı gerçekleştirmek.

Bu kurallara aykırı davranan kullanıcıların erişimi hiçbir bildirim yapılmaksızın sonlandırılabilir ve yasal yollara başvurulabilir.

10. Sorumluluk Sınırlaması

Yürürlükteki hukukun izin verdiği azami ölçüde, plssem.com ve geliştiricisi hiçbir koşulda aşağıdakilerden sorumlu tutulamaz:

  • Analiz sonuçlarının yanlış yorumlanmasından veya kullanılmasından doğan zararlar,
  • Üçüncü taraf kütüphanelerin hatalarından kaynaklanan yanlış hesaplama sonuçları,
  • Hizmet kesintisi, sunucu arızası veya veri kaybı,
  • Akademik yayın, tez veya raporlarda kullanılan sonuçların neden olduğu mesleki veya itibar zararları,
  • Dolaylı, arızi, özel veya cezai nitelikteki zararlar.
⚖️ Hizmet'in yıllık ücretli kullanımı söz konusu olsa dahi, plssem.com'un toplam sorumluluğu ödenen ücretle sınırlıdır. Ücretsiz kullanımda ise herhangi bir tazminat yükümlülüğü bulunmamaktadır.

11. Hizmet Kesintisi ve Değişiklik Hakkı

plssem.com aşağıdaki hakları saklı tutar:

  • Hizmet'i önceden bildirim yapmaksızın geçici veya kalıcı olarak askıya almak,
  • Bu Şartları herhangi bir zamanda güncellemek (güncellemeler sitede yayımlandığı andan itibaren geçerlidir),
  • Ücretsiz özellikleri ücretli hale getirmek veya mevcut özellikleri kaldırmak,
  • Teknik altyapıyı, kullanılan kütüphaneleri veya analiz motorunu değiştirmek.

12. Uygulanacak Hukuk ve Yetki

Bu Şartlar, Türkiye Cumhuriyeti hukukuna tabidir. Bu Şartlar'dan doğabilecek her türlü uyuşmazlıkta Türk Mahkemeleri yetkilidir.

Uluslararası kullanıcılar için: Hizmet Türkiye'den sunulmaktadır. Kullanıcılar, kendi ülke mevzuatlarına uygunluktan bizzat sorumludur.

plssem.com'un analiz motoru, aşağıdaki açık kaynak Python kütüphaneleri üzerine inşa edilmiştir. Bu kütüphaneler kendi lisans şartları kapsamında kullanılmakta olup her birinin telif hakkı sahibine ait tüm haklar saklıdır:

1. General Information and Acceptance

These Terms of Use and Privacy Policy ("Terms") govern the use of the plssem.com website ("Site") and the PLS-SEM Data Analysis Robot software service ("Service") provided through this site.

By visiting the Site, using any of its features, or uploading data, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree to these Terms, please do not use the Service.

2. Scope and Limitations of Service

The Service is an online analysis tool that performs PLS-SEM (Partial Least Squares Structural Equation Modeling) and CFA (Confirmatory Factor Analysis) operations for academic research purposes.

  • Intended for academic and research use only.
  • Supported file formats: Excel (.xlsx, .xls), CSV
  • Maximum file size: 50 MB
  • The Service may be modified, suspended, or terminated without prior notice.

3. Third-Party Software and Disclaimer

⚠️ This section contains important liability limitations regarding the technical infrastructure of the Service. Please read carefully.

The analysis engine of plssem.com is built entirely upon open-source Python libraries. These libraries handle statistical computation, modeling, regression, resampling, and data processing. The primary independent software components used include:

  • semopy — Structural equation modeling (SEM) library
  • pandas — Data frame processing and manipulation
  • numpy — Numerical computation infrastructure
  • scipy — Statistical functions
  • scikit-learn — Machine learning and statistical tools
  • statsmodels — Econometric and statistical models
  • FastAPI — Web application framework

These libraries were not developed by plssem.com, and each has its own license terms, error margins, and version constraints. plssem.com shall not be held responsible for any of the following arising from these third-party software components:

  • Incorrect, incomplete, or misleading results produced,
  • Incompatibility with specific datasets,
  • Behavioral changes due to version updates,
  • Mathematical deviations in computation processes,
  • Convergence errors in bootstrap, regression, or factor analysis procedures.

By using the Service, the user acknowledges and accepts the inherent limitations of these third-party software components.

4. Accuracy of Analysis Results and Academic Responsibility

🔴 Important Notice: Analysis results produced by plssem.com must be independently verified by the user before being used in academic work.

The Service is provided on an "as-is" basis. No express or implied warranties are given regarding the accuracy, completeness, or fitness for a particular purpose of the analysis results.

The user assumes full scientific, ethical, and legal responsibility for using these results in academic publications, theses, projects, or any official documents. plssem.com and its developer shall not be liable for any damages resulting from the use of misinterpreted or unverified results.

5. Premium Access and Key System

Certain features of the Service (Bootstrap 5000, CFA Analysis, Word Report download) are available only with a valid access key. The following terms apply to the key system:

  • Each key is bound to a single device. Device registration occurs upon first use.
  • Transferring or sharing a key with others is strictly prohibited.
  • Time-limited keys automatically expire on the specified date.
  • Keys may be revoked at any time without reason.
  • Key purchases or transfers do not entitle the user to any refund or compensation.
  • plssem.com reserves the right to modify, remove, or restructure the key system.

6. Data Privacy and Personal Data

✅ plssem.com does not collect any personal data. No registration is required, and information such as name, surname, email address, or phone number is neither requested nor stored.

Data files uploaded by users (Excel, CSV, etc.):

  • Are held temporarily in server memory only during the analysis process.
  • Are automatically deleted when the analysis is complete or the session ends.
  • Are not permanently saved to the server or shared with third parties.
  • Are not backed up or archived.

This Service does not process personal data under the Turkish Personal Data Protection Law (KVKK No. 6698). For users in the European Union, no personal data is processed under the General Data Protection Regulation (GDPR).

7. Device Identification, IP Logging, and Technical Data

For security and access management purposes, the Service may process the following technical data:

  • IP address: Received by the server with each API request. Used for device registration during key verification and recorded against the key entry.
  • Browser fingerprint: A hash value computed from browser characteristics including screen resolution, browser language, timezone, and operating system platform is linked to the key. This data is not sufficient to identify an individual and is used solely for device matching purposes.
  • Usage statistics: Usage count per key and the date of last use are recorded.
  • Server logs: Standard server logs may be maintained for technical errors and security events.

This data is not shared with third parties, not used for advertising purposes, and user profiling is not performed.

8. Intellectual Property Rights

All original software code, interface design, content, and methodology on plssem.com belong to Dr. Yavuz Toraman and are protected under copyright law.

  • Copying the source code, reverse engineering, or developing derivative software is prohibited.
  • Unauthorized reproduction or distribution of site content is prohibited.
  • Data uploaded by users belongs to the user; plssem.com makes no claim over such data.
  • Analysis outputs produced through the Service may be used for academic purposes; citation is recommended.

Third-party open-source libraries are used under their respective license terms (MIT, BSD, Apache, etc.).

9. User Obligations and Prohibitions

The user agrees not to engage in the following actions:

  • Accessing the Service via bots, automated scripts, or scrapers,
  • Sharing a key with others or attempting to use it on multiple devices,
  • Using the Service for malicious, deceptive, or unlawful purposes,
  • Attempting to circumvent the security mechanisms of the Service,
  • Uploading illegal, confidential, or third-party rights-infringing data,
  • Overloading the Service's servers or conducting a DDoS attack.

Users who violate these rules may have their access terminated without notice, and legal action may be pursued.

10. Limitation of Liability

To the maximum extent permitted by applicable law, plssem.com and its developer shall under no circumstances be liable for:

  • Damages arising from the misinterpretation or use of analysis results,
  • Incorrect computation results caused by errors in third-party libraries,
  • Service interruptions, server failures, or data loss,
  • Professional or reputational damages caused by results used in academic publications, theses, or reports,
  • Indirect, incidental, special, or punitive damages.
⚖️ Even if the Service involves annual paid usage, plssem.com's total liability is limited to the amount paid. For free usage, no compensation obligation exists.

11. Service Interruption and Right to Modify

plssem.com reserves the following rights:

  • To suspend the Service temporarily or permanently without prior notice,
  • To update these Terms at any time (updates take effect from the moment they are published on the site),
  • To convert free features to paid or to remove existing features,
  • To change the technical infrastructure, libraries used, or analysis engine.

If you have used this Service in your academic work, the following citation format is recommended:
